This document sets out the rules for using the Internet site www.e-pitti.com. Browsing the Internet site
www.e-pitti.com and using its functionalities means accepting these rules.

1. DEFINITIONS
For the purposes of these rules, the terms listed below have the following meanings:
a) Site: the Internet site www.e-pitti.com;
b) FieraDigitale: the company FieraDigitale s.r.l. with headquarters in Florence, via Faenza n. 111, 5012 Florence, (VAT no. IT-06040940485);
c) Pitti Immagine: the company Pitti Immagine s.r.l., with headquarters in Florence, via Faenza n. 111, 5012 Florence, (VAT no. IT-03443240480);
d) Users: users in possession of authentication credentials for accessing the restricted areas of the site, whether exhibitors or buyers;
e) Buyers: users registered as visitors to fairs organised by Pitti Immagine;
f) Exhibitors: those who have exhibited their products at fairs organised by Pitti Immagine;
g) Reserved Area: the section of the site that hosts a digital replica of the fairs organised by Pitti Immagine, of a temporary nature.

2. SITE OWNERSHIP, COPYRIGHT
The site is owned by FieraDigitale.
The design, layout, graphics, images, audio and video content, text, management software and software running on the site and the respective source code, together with the trademarks present on the site, are owned by FieraDigitale or licensed to FieraDigitale for publication on the site. Any use of the aforementioned material other than for browsing, or, for users, completing operations expressly permitted by the site, is strictly prohibited. In particular, it is prohibited to modify, copy, reproduce, disseminate, send or disclose the contents of the site without authorisation. It is also prohibited to copy or trace the source code of the management software or the software running on the site.
The brands, models, drawings and trademarks present in the reserved area and in the exhibition space of each exhibitor are the property of their respective owners and any use of them without prior consent is strictly prohibited.

3. PERSONAL DATA
Personal data is processed for the purpose, and according to the procedures, set out in the information notice available here.

4. GENERAL RULES OF CONDUCT ON THE SITE
FieraDigitale provides this site in order to allow exhibitors and buyers to meet and close business deals. Site users are professional operators who are required to conduct themselves in keeping with the usual ways of making contact and concluding deals between professionals.
In particular, it is prohibited:
a) to use insulting, vulgar or offensive remarks as part of communications between exhibitors and buyers on the site;
b) to use the site to breach the law or to violate the rights of third parties or the rights of FieraDigitale;
c) to use the site to collect, manually or automatically, the personal data of third parties without their expressed consent;
d) to publish or communicate false or inaccurate data;
e) to spread spam, viruses, spyware or any other software on the site aimed at damaging, hampering, slowing down or shutting down the functionality of the site;
f) in general, to use the site for purposes other than those for which it was designed and to conduct activities other than those expressly permitted by the functionalities of the site.

5. EXCLUSION OF LIABILITY
FieraDigitale intends to make the site an area where business deals can be safely concluded between exhibitors and buyers. FieraDigitale intends, to the best of its ability, to prevent the site from being used in ways that do not comply with these rules. To this end, FieraDigitale and Pitti Immagine conduct various checks at the time of accrediting the exhibitors and buyers.
FieraDigitale is not, however, liable for content placed on the site by exhibitors, even when its insertion is completed by FieraDigitale.
FieraDigitale obtains photographs, videos and text directly from exhibitors and is unable to verify the lawfulness or legitimate ownership of that material, nor the conformity of what is contained within the same with the exhibitors’ products.
In no case may FieraDigitale be deemed in any way liable in the event that:
a) the products shown on the site differ from those actually made by the exhibitor;
b) the products shown on the site breach the rights or industrial or intellectual property rights of third parties;
c) the contact details for the exhibitors or buyers are wholly or partially inaccurate.
In no case may FieraDigitale be deemed liable for damages of any nature caused directly or indirectly from accessing the site, from the inability or impossibility of accessing the site, from using the site functionalities or from using the information contained within.
FieraDigitale is not liable when the entire site, or any of the site’s functionalities, are temporarily unavailable to users. In this regard, it is noted that the online fair hosted in the reserved area is, by nature, a service with functionality limited to a certain period of time. Without prejudice to the liability disclaimer above, FieraDigitale informs users in advance by email in the event that, for reasons of updates or technical maintenance to the site, its components, software management or software running on the site is likely to be temporarily or partially unavailable for use.
FieraDigitale is not in any way liable for the content of communications sent by users on the site. FieraDigitale is not in any way liable for user violations of the general rules of conduct detailed in the 4th point, ‘General Rules of Conduct on the Site’.
FieraDigitale reserves, in any case, the right to temporarily or permanently suspend the user accounts of anyone breaching these rules. An account suspension is communicated to users by an email sent to the address associated with the authentication credentials. The account suspension for breaching these rules does not entitle the user to reimbursement, repayment or compensation from FieraDigitale.
This site contains hyperlinks (links) to third party websites on which FieraDigitale exercises no control or monitoring. FieraDigitale is not, in any way, liable for information provided by third-party websites to which users can connect via this site. Recommendations or opinions expressed on third party websites are the sole responsibility of the owners of such sites, and in no way constitute the recommendations or opinions of FieraDigitale.

6. RULES FOR EXHIBITORS
In order to access the reserved area, exhibitors of Pitti Immagine must sign a contract with Pitti Immagine or with Fiera Digitale.
Use of the site is regulated by the contract and by these rules.
The site is designed so that the reserved area can only be accessed by professional buyers through an authentication process. The authentication process is the only medium that allows FieraDigitale to identify the user as a buyer. Although there are a number of checks on the activity that takes place in the reserved area, aimed at identifying unauthorised users of the site, FieraDigitale cannot guarantee that the authenticated user is actually the buyer.

7. RULES FOR BUYERS
Access to the reserved area is permitted exclusively to professional buyers who are registered and verified as such through the authentication process. Visitors who are not professionals may not access the reserved area.
7.1 – Using the authentication credentials
The authentication credentials (username and password) that the buyer has received following the validation process are strictly personal and may not be passed on. They must be kept confidential and looked after with due care and attention.
Transferring, disclosing or in any way voluntarily or negligently making the authentication credentials available to third parties constitutes a serious breach of the rules for using the site.
If, for any reason, the buyer is sure or suspects that his/her authentication credentials may have been disclosed to third parties, the buyer must change them immediately using the appropriate settings panel.
Where FieraDigitale becomes aware, including by notification from exhibitors, that the authentication credentials are being or appear to be used by third parties, it has the right to temporarily suspend access to the reserved area and to request relevant information from the buyer by sending an email to the address associated with his/her authentication credentials. In the event of no response being received within 48 hours, FieraDigitale will permanently suspend the access to the reserved area. In this case, access will only be possible following renewal of the validation process.
7.2 – Contact with exhibitors
Contact and communication with exhibitors using the site must be conducted in the utmost seriousness.
By using the site, the buyer authorises the site to send his/her personal data to the exhibitor.

8. APPLICABLE LAW AND TERRITORIAL JURISDICTION
Any dispute regarding use of the site and its functionalities is governed by Italian law. Jurisdiction is held by the Italian judiciary authority and the Court of Florence is the exclusive competent court.

9. AMENDMENTS AND NEW VERSIONS OF THE RULES
FieraDigitale has the right to amend these rules at any time or to issue new versions of them.
Alterations to the rules and subsequent versions of them come into effect for new users as soon as they are published on the site.
In the event of amendments to the rules or new versions of the same being issued, FieraDigitale will send a notification email to users containing a link to the amendments or the new version of the Rules. The Rules shall be applied to users following a term of thirty days from notification, where they have not arranged to cancel their personal account within that term.

10. ORGANISATIONAL MODEL AND OTHER OBLIGATIONS PURSUANT TO ITALIAN LEGISLATIVE DECREE NO. 231/2001
The Organisational Model (the “Model”) pursuant to Italian Legislative Decree no. 231/2001 adopted by FieraDigitale s.r.l. introduces a system of administrative (and criminal) liability for companies with respect to certain types of offences. The model consists of the”General Part” and “Special Parts” prepared for the various types of offences.
Any violation or suspected violation of the Model and / or any other information pertaining to the implementation of the model may be reported to the Supervisory Body of the Company.
